Legal regulation of genetic testing in sport

Аннотация:

The article presents an overview and the main trends in the regulation of genetic testing in sports. The specific nature of sports activity is noted, where the selection of candidates  by physical parameters is an integral part of it, which is why when using genetic testing, two values collide: the «essence» of sports and the right to privacy. The main ways of using genetic testing in the field of doping checks, medical examinations, identification of talented athletes and other areas are revealed. Taking into account the presumption of the results of genetic testing, the author concludes that its admissibility should be determined based on the purposes of conducting, as well as objective necessity. It is pointed out that employees are defenseless during genetic testing due to the lack of Russian labor legislation, an economic and legal analysis of the determining role of the behavior of the employer (sports club) in the choice of an employee (player) is carried out.
