Аннотация:

The article is devoted to a comprehensive analysis of following legal technique elements of the 1960 RSFSR Criminal Code: 1. linguistic (in terms of the sensory and emotional component of «legal communication»), 2. terminological (in «person – the text of the law» relationships), that caused difficulties in understanding by ordinary Soviet citizens, which is the reason why there was a gap in communication between the people and the state, 3. the philosophical foundations and features of the 1960 Criminal Code (with regard to the influence of essence of normative legal acts language on human existence) through the historical and linguistic axis of the legal documents and terminology evolution. The author concludes that in process of drafting the 1960 Criminal Code there was the apparent policy of maneuvering between different social groups in order to satisfy people as a whole. On the basis of the linguistic-historical legal methodology, the specificity of the Criminal Code on above-mentioned aspects of the study was revealed, which leads to the conclusion about the need for balance between two poles: sensual-emotional and formal-legal in order to increase the efficiency of the legal regulation process.
